Gary Strong and Kevin Riexinger Successful in their Motion for Summary Judgment in Supreme Court of New York

Gary Strong and Kevin Riexinger (collectively “SGL”) were successful in their Motion for Summary Judgment in the Supreme Court of New York, Westchester County. SGL represented a contractor who performed work on a private commercial building.  The work was completed in 2002 and the lawsuit was filed in 2018. SGL filed a pre-answer motion to dismiss arguing the applicable Statute of Limitations had expired.  On reply SGL successfully argued that Plaintiff’s claim for fraud and/or misrepresentation (which could have extended the applicable Statute of Limitations) should also be dismissed because these claims arose out of the breach of contract and negligence that Plaintiff was claiming.
